1. Legal information and acceptance.
These provisions regulate the use of the web service (hereinafter, the "Website") that FUNDACIÓN MOP - THE MOP FOUNDATION, (hereinafter, THE MOP FOUNDATION) makes available to Internet users. THE MOP FOUNDATION has its corporate address at Cantón Grande no. 4, 15003 - A Coruña and Corporate Tax ID no. G-10.555.431.
The use of the Website grants the status of user of the Website (hereinafter, the "User") and implies the acceptance of all the conditions included in this Legal Notice. The rendering of the Website service has a limited duration at the moment in which the User is connected to the Website or to any of the services provided through the same. Therefore, the User must carefully read this Legal Notice on each of the occasions in which they intend to use the Website, since the conditions of use contained in this Legal Notice may change.

2. Object.
The purpose of these provisions is to regulate how Users may use the website of the MOP FOUNDATION currently located at the URL www.themopfoundation.org, without prejudice to the fact that certain services or contents of the website are subject to their own particular conditions, regulations and instructions that, where appropriate, may replace, complete and/or modify this Legal Notice and which must be accepted by the User before the provision of the corresponding service begins.

3. Access.
Access to and use of the Website is free of charge for Users (except for the cost of the connection through the telecommunications network provided by the access provider contracted by Users) and does not require prior registration of the User in general. However, access to and use of certain information and services offered through the Website may only be done with prior User registration.

In the case of User registration through identifiers and passwords, both the identifier and the password will belong exclusively to the person to whom they are granted. The User will be solely responsible for keeping both the identifier and the password in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind derived from the breach or disclosure of the secret.

4. Intellectual and industrial property.
All the contents of the Website, understanding as such, but without limitation, the texts, photographs, software, links, and other audiovisual or sound content, as well as its graphic design, source codes, browsing structures, and other telematic services or products included on the Website (hereinafter, the "Contents") are the exclusive property of THE MOP FOUNDATION or third parties, and none of the exploitation rights recognised by current regulations on intellectual property on the same can be understood as assigned to the user, therefore, the User undertakes not to violate any intellectual or industrial property right, its total or partial reproduction, public communication, distribution or any other form of exploitation being expressly prohibited, except with the express written consent of THE MOP FOUNDATION. The User undertakes to use this information and services exclusively for their own needs and not to carry out directly or indirectly a commercial exploitation of the services to which they have access or of the results obtained through the use of the Website, except with the express consent of THE MOP FOUNDATION. The User undertakes not to use the facilities and capacities of the Website to carry out or suggest activities prohibited by law or to try to attract Users to other competing services.

The trademarks, trade names or distinctive signs are the property of THE MOP FOUNDATION or third parties, and are protected by current legislation on industrial property, without it being understood that access to the Website attributes any right over the aforementioned trademarks, trade names and/or distinctive signs.

5. General conditions of use.
5.1 General aspects
The User undertakes to correctly use the Website in accordance with the Law and this Legal Notice and will respond to THE MOP FOUNDATION or to third parties for any damages that may be caused as a result of breaching said obligation.
THE MOP FOUNDATION reserves the right to block the access of Users who use the Website in a manner contrary to the Law or the conditions of this Legal Notice, being able to cancel or block, as the case may be, the identifier and password of registered Users. .
It is expressly prohibited to use the Website for purposes that are detrimental to the goods or interests of THE MOP FOUNDATION or third parties or that in any other way overload, damage or disable networks, servers and other computer equipment (hardware) or computer products and applications (software) of THE MOP FOUNDATION or third parties.

5.2 Contents
The User undertakes to use the contents in accordance with the Law and this Legal Notice, as well as with the other conditions, regulations and instructions that are applicable in accordance with the provisions of clause 2. By way of example, the user, in accordance with current legislation, must refrain from:

• Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Contents except in cases authorised by law or expressly consented to by THE MOP FOUNDATION or by whoever holds the ownership of the exploitation rights as it may apply.
• Reproducing or coping for private use the Contents that are considered Software or Database in accordance with current legislation on intellectual property, as well as their public communication or making them available to third parties when these acts necessarily imply reproduction by the User or a third party.
• Extracting and/or reusing all or a substantial part of the Contents of the Website and the databases that THE MOP FOUNDATION makes available to the Users.

5.3 Data collection forms.
Notwithstanding the provisions of clause 7 of this Legal Notice, as well as the privacy policies accessible from the Website and applicable at all times, the use of certain services or requests addressed to THE MOP FOUNDATION are contingent upon the prior completion of the registration of the User.

All information provided by the User through the forms on the Website for the above or any other purposes must be truthful. For these purposes, the User guarantees the authenticity of all the data communicated and will keep the information provided to THE MOP FOUNDATION perfectly updated so that it responds, at all times, to the User's real situation. In any case, the User will be solely responsible for the false or inaccurate statements made and the damages caused to THE MOP FOUNDATION or to third parties due to the information provided.

5.4 Introduction of links to the Website.
Internet users who wish to introduce links from their own web pages to the Website must comply with the conditions detailed below, without ignorance of the same avoiding the liabilities derived from the Law.
It may be linked to any web page with the exception of those that include personal data, databases or other information subject to data protection regulations, but it may not be reproduced in any way (online links, copy of texts, graphics, etc.).
It is prohibited in any case, in accordance with the applicable legislation in force at any time, to establish frames of any kind that surround the Website or allow the display of the Contents through Internet addresses other than those of the Website and, in any case, when viewed together with content outside of the Website in a way that (i) produces, or may produce, errors, confusion or deception in Users about the true origin of the service or Content; (ii) involves an act of unfair comparison or imitation; (iii) serves to take advantage of the reputation of the brand and the prestige of THE MOP FOUNDATION; (iv) in any other way is prohibited by current legislation.
The page that introduces the link may not make any type of false, inaccurate or incorrect statement about THE MOP FOUNDATION, its partners, employees or clients, or about the quality of the services it provides.
In no case will it be stated on the page where the link is located that THE MOP FOUNDATION has given its consent for the insertion of the link or that it sponsors, collaborates, verifies or supervises the sender's services in any other way.
The use of any word, graphic or mixed mark, or any other distinctive sign of THE MOP FOUNDATION within the web page is prohibited.

6. Exclusion of liability.
6.1 Information.
Access to the Website does not imply an obligation on the part of THE MOP FOUNDATION to verify the veracity, accuracy, adequacy, suitability, completeness and timeliness of the information provided through it.

THE MOP FOUNDATION is not responsible for decisions made based on the information provided on the Website or for damages caused to the user or third parties due to actions based solely on the information obtained on the Website.

6.2 Quality of the service.
Access to the Website does not imply an obligation on the part of THE MOP FOUNDATION to control the absence of viruses, worms or any other harmful computer element. It is up to the User, in any case, to have adequate tools for the detection and disinfection of harmful computer programs.
THE MOP FOUNDATION is not responsible for damages caused to the computer equipment of Users or third parties during the provision of the Web service.

6.3 Availability of the service.
Access to the Website requires services and supplies from third parties, including transport through telecommunications networks whose purpose, quality, continuity and operation do not correspond to THE MOP FOUNDATION. Consequently, the services provided through the website may be suspended, cancelled or made inaccessible, prior to or simultaneously with the provision of the web service.
THE MOP FOUNDATION is not responsible for damages or losses of any kind caused to the User that cause failures or disconnections in the telecommunications networks that cause the suspension, cancellation or interruption of the Web service during the provision of the same or prior to it.
THE MOP FOUNDATION may make the modifications it deems appropriate on the Website, being able to include additional services and content to the current ones or, where appropriate, eliminate them. THE MOP FOUNDATION may modify the Website whenever it deems appropriate and may block access to all or part of the Users of the Website to carry out the modifications or repairs it deems necessary at any time. The Website access service includes technical link devices, directories and even search tools that allow the user to access other Internet pages and portals (hereinafter, "Linked Sites"). In these cases, THE MOP FOUNDATION acts as a provider of intermediation services in accordance with article 17 of Law 34/2002, of 12 July, on Information Society Service and E-commerce (LSSI) and will only be responsible for the contents and services provided on the Linked Sites to the extent that they have effective knowledge of the illegality and have not deactivated the link with due diligence.
In the event that the User considers that there is a Linked Site with illegal, harmful, denigrating, violent, immoral or inappropriate content, they may notify THE MOP FOUNDATION, without this communication entailing the obligation to remove the corresponding link in any case. In no case should the existence of Linked Sites presuppose the existence of agreements with those responsible or owners thereof, nor the recommendation, promotion or identification of THE MOP FOUNDATION with the statements, contents or services provided.
THE MOP FOUNDATION is not aware of the contents and services of the Linked Sites and therefore is not responsible for damages caused by the illegality, lack of quality, outdatedness, unavailability, error and uselessness of the contents and/or services of the Linked Sites nor for any other damage that is not directly attributable to THE MOP FOUNDATION.
